Understanding Trade Remedies: Safeguarding Domestic Industries in a Globalized Economy
Trade remedies are essential tools in the toolkit of international trade, designed to ensure fair competition and protect domestic industries from unfair practices. Defined and regulated by the World Trade Organization (WTO), these measures aim to combat issues such as dumping—where companies export goods at prices lower than their home market—and subsidies that create an uneven playing field. As global trade continues to evolve, the importance of these remedies grows, especially for developing nations like Việt Nam.
The Role of Trade Remedies in Global Trade
As economies become increasingly intertwined, the demand for trade remedy tools is on the rise. Countries recognize that these measures are necessary to stabilize domestic production and safeguard local employment. By addressing the unfair advantages created by international competitors, trade remedies help ensure that domestic industries can thrive in a competitive environment.
Việt Nam and Free Trade Agreements
Việt Nam has been proactive in engaging with the global economy, having signed 15 Free Trade Agreements (FTAs) to date, with two additional negotiations currently underway. Among these, the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), the Việt Nam-European Union Free Trade Agreement (EVFTA), and the UK-Việt Nam Free Trade Agreement (UKVFTA) stand out as new-generation FTAs. These agreements not only expand market access but also create an influx of foreign investment, enhancing Việt Nam’s competitive edge in the export sector.

Challenges Posed by FTAs
While FTAs open new avenues for export growth, they also present challenges. Domestic producers face risks related to origin fraud, illegal goods transfers, and attempts to circumvent trade remedy taxes. These challenges threaten the sustainability of local industries, making it essential for the Vietnamese government to take proactive measures.
Government Initiatives to Strengthen Trade Remedy Capacity
To mitigate these challenges, the Vietnamese government, in collaboration with the Ministry of Industry and Trade, has initiated various projects designed to enhance the capacity of local businesses in utilizing trade remedies effectively. The Prime Minister has approved two significant projects focused on strengthening state management against trade remedy evasion and establishing a robust early warning system for trade remedies. These initiatives aim to provide a defense against foreign trade remedy lawsuits and ultimately support sustainable export practices.
Enhancing Legal Frameworks for Trade Remedies
Another vital aspect of Việt Nam’s strategy involves ratifying a project aimed at bolstering trade remedy capacity within the context of new-generation FTAs. This project seeks to create a comprehensive framework that enhances the effectiveness of trade remedies while improving business awareness of these tools. The overarching goal is to refine the legal landscape governing trade remedies to ensure that it aligns with international commitments and the interests of the Vietnamese economy amidst increasing globalization.
Reviewing Legal Documents
As part of the project, there will be a systematic review of existing legal documents related to trade remedies from 2022 to 2025. This review will facilitate amendments to the Law on Foreign Trade Management or potentially lead to the development of a dedicated Law on Trade Remedies. Such reforms are vital for maintaining consistency with international trade rules while safeguarding domestic industries.
Ongoing Coordination and Action Plans
The Ministry of Industry and Trade is actively coordinating with relevant ministries and agencies to implement effective action plans that align with these projects. The objective is to ensure the full realization of goals aimed at protecting the legitimate rights and interests of Vietnamese manufacturers.
By fostering a robust legislative framework and enhancing the knowledge and capabilities of local businesses, Việt Nam aims to effectively navigate the complexities of international trade and safeguard its domestic market in an increasingly competitive global landscape.
